The Special Officer for Linguistic Minorities (SOLM), who is known as the Commissioner for Linguistic Minorities in India (CLM), is a constitutional authority appointed by the President of India to investigate matters relating to the safeguards provided for linguistic minorities and report on their implementation.

Who are Linguistic Minorities?

The Constitution does not define the term linguistic minority. Generally, linguistic minorities at the State level means any group or groups of people whose mother tongues are different from the principal language of the State, and at the district and taluka/tehsil levels, different from the principal language of the district or taluka/tehsil concerned.

The language of a linguistic minority need not necessarily be one of the 22 languages listed in the Eighth Schedule of the Constitution.

Evolution of the Commissioner for Linguistic Minorities

  • Originally, the Constitution of India did not contain any provision regarding a Special Officer for Linguistic Minorities.
  • The States Reorganisation Commission (SRC), 1955 recommended the creation of a mechanism to protect the interests and address the grievances of linguistic minorities.
  • Based on these recommendations, the 7th Constitutional Amendment Act, 1956 inserted:
    • Article 350A – Facilities for instruction in the mother tongue at the primary stage.
    • Article 350B – Special Officer for Linguistic Minorities.

Establishment

  • The Commissioner for Linguistic Minorities Organisation was established in July 1957.
  • Initially headquartered at New Delhi, it was later shifted to Allahabad (Prayagraj).
  • The headquarters was shifted back to New Delhi with effect from 1 June 2015.

Constitutional Provisions

Article 350B

  1. There shall be a Special Officer for Linguistic Minorities, appointed by the President of India.
  2. It shall be the duty of the Special Officer to:
    • Investigate all matters relating to the constitutional safeguards provided to linguistic minorities.
    • Submit reports to the President at such intervals as the President may direct.
    • The President shall place these reports before each House of Parliament and forward them to the concerned State Governments.

Organisation

Functions

  1. Investigates all matters relating to the safeguards provided to linguistic minorities under the Constitution and other accepted arrangements.
  2. Submits reports to the President of India on the status of implementation of constitutional and nationally agreed safeguards for linguistic minorities.
  3. Monitors the implementation of safeguards.

Role

  • The CLM interacts with states/UTs on all the matters pertaining to the issues concerning implementation of the Constitutional and nationally agreed safeguards provided to linguistic minorities.
  • The CLM Organisation takes up all matters relating to the Safeguards for linguistic minorities brought to its notice by linguistic minority groups/associations/organisations. The CLM personally visits linguistic minority areas and educational institutions for an on-the-spot assessment of the status of implementation of the Scheme of Safeguards. 
  • In this connection, the Commissioner holds discussions with the Chief Ministers, Governors and at the highest levels of administration at the States/UTs.
