Governor as an Agent of the Centre

The Governor occupies a unique position in India’s federal structure, being appointed by the President but functioning as the constitutional head of the state government. This dual role has led to debates about the governor’s independence and relationship with the central government.

Arguments Suggesting the Governor Acts as an Agent of the Centre

  • Appointment and removal: 
    • Appointed by the President on the advice of the central government, potentially compromising their independence; 
    • Removed at the centre’s pleasure without any specified grounds, creating insecurity of tenure; 
    • Frequent transfers and appointments of governors aligned with the ruling party at the centre raise questions about impartiality. 
    • Political appointments
      • Former politicians, Union ministers and retired officials associated with the ruling party at the Centre are frequently appointed as Governors, creating concerns about partisan loyalty.
  • Reporting and advisory role: 
    • Required to keep the President informed about the state’s affairs, suggesting a reporting relationship to the center
      • The Governor regularly sends reports to the President concerning the administration and constitutional situation in the State. 
    • The centre often uses governors to gather intelligence about political developments in states
    • Governors’ reports have been used to justify the imposition of President’s rule, sometimes controversially. 
      • Allegations of partisan reporting have led to the dismissal of elected State governments in the past. 
  • Implementation of centre’s agenda:
    • Governors have often been accused of pushing the centre’s political agenda in opposition-ruled states;
    • Delays in giving assent to bills passed by state legislatures have been seen as politically motivated
      • The absence of a definite constitutional timeline has historically enabled politically sensitive legislation to be delayed or referred to the Union. 
      • Governors have delayed assent to Bills passed by State Legislatures, producing a “pocket veto” effect and obstructing the legislative programme of elected State governments. 
    • Selective use of discretionary powers, such as calling for floor tests, has been criticized as favouring the centre’s interests. 
      • Governors have faced criticism for directing floor tests, advancing legislative sessions or intervening in political disputes in ways that affect the survival of State governments. 
  • Lack of accountability to state legislature:
    • Although the Governor exercises significant constitutional authority within the State, the office is neither elected by the people nor removable by the State Legislature. 
      • Unlike the President, there is no impeachment provision for governors
      • Not answerable to the state legislature for their actions, unlike other constitutional authorities

The office of Governor should function as an impartial constitutional authority rather than as an instrument of the Union government. Its legitimacy ultimately depends on maintaining political neutrality, respecting the mandate of elected State governments and facilitating cooperative Centre-State relations within the constitutional framework.
