Lengthiest Written Constitution

The Indian Constitution is the lengthiest written Constitution of any sovereign nation. At its commencement in 1950, it contained 395 Articles, 22 Parts and 8 Schedules; over time, through constitutional amendments, it has expanded to cover a wider range of governance, rights, institutions and federal arrangements. Its length reflects India’s social diversity, federal complexity and transformative constitutional vision.

Reasons behind the extensive length

  • Historical influence of the Government of India Act, 1935
    • A significant portion of India’s constitutional text was drawn from the Government of India Act, 1935 — a detailed, administratively comprehensive document 
  • Administrative detail constitutionalised 
    • Unlike constitutions of older democracies that leave administrative arrangements to ordinary legislation, India’s framers chose to embed significant administrative detail within the constitutional text itself 
      • The Indian Constitution contains detailed provisions relating to Parliament, State Legislatures, judiciary, elections, services, Public Service Commissions, CAG and other constitutional bodies. 
  • Single Constitution for Centre and States 
    • Unlike federal comparators — the US has a federal constitution and 50 separate state constitutions — India chose a single constitution governing both the Union and the states 
  • Borrowing from multiple constitutions
    • The framers adopted the best features from various constitutions of the world. 
      • For example, Fundamental Rights were inspired by the USA, Directive Principles from Ireland, parliamentary system from Britain and emergency provisions from Germany. This widened the scope of the Constitution. 
  • Accommodation of India’s diversity 
    • India’s linguistic, religious, caste, tribal, regional and cultural diversity required detailed constitutional safeguards. Hence, provisions were included for minorities, Scheduled Castes, Scheduled Tribes, official languages and special regions. 
      • Part XVI of the Indian Constitution (Articles 330–342) outlines special provisions for certain classes. It ensures political representation, equal opportunity, and affirmative action for Scheduled Castes (SCs), Scheduled Tribes (STs) etc ..
        • Articles 330 & 332: Reserve seats for SCs and STs in the Lok Sabha and State Legislative Assemblies. 
  • Federal asymmetry
    • Another reason for the constitution to be so lengthy is the inclusion of special provisions to deal with asymmetric dimensions of the Indian federation. 
    • Certain states and regions required special constitutional arrangements due to their historical, cultural or geographical conditions. Provisions relating to states like Nagaland, Assam, Manipur, Sikkim and Mizoram added to its length. 
  • Living and evolving document
    • The Constitution has expanded through amendments to respond to changing socio-political needs. For example, the 73rd and 74th Amendments added provisions relating to Panchayats and Municipalities. 
  • Legal expertise of the Constituent Assembly
    • The presence of legal experts in the Constituent Assembly contributed to detailed drafting. The framers aimed to minimise ambiguity and provide a comprehensive framework for governance.

Thus, the length of the Indian Constitution is not a weakness but a reflection of India’s diversity, administrative complexity, federal needs and transformative goals. It remains a detailed framework for democratic governance and social justice.
