Electronic Voting Machines (EVM)

The Electronic Voting Machine represents one of the most consequential and contested technological interventions in Indian electoral democracy — a device that has simultaneously transformed the mechanics of electoral participation for hundreds of millions of citizens and become the most politically charged symbol of electoral integrity debates in contemporary India. No other electoral technology has attracted comparable controversy  not because the controversy is necessarily proportionate to actual risk, but because the EVM sits at the intersection of democratic legitimacy, technological trust, political competition, and institutional credibility in ways that make any question about its functioning politically explosive.

India’s journey from paper ballots to EVMs  and the ongoing debates about their integrity  reflects broader global questions about how democracies should balance technological efficiency with democratic transparency, and how electoral institutions can maintain public confidence in systems that increasing numbers of citizens — rightly or wrongly — distrust.

Historical Background

  • First time use of EVMs occurred in the general election in Kerala in May, 1982; however, the absence of a specific law prescribing its use led to the Supreme Court striking down that election. 
  • Subsequently, in 1989, the Parliament amended the Representation of the People Act, 1951 to create a provision for the use of EVMs in the elections 
  • A general consensus on its introduction could be reached only in 1998 and these were used in 25 Legislative Assembly constituencies spread across three states of Madhya Pradesh, Rajasthan and Delhi. 
  • Its use was further expanded in 1999 to 45 Parliamentary Constituencies and later, in February 2000, to 45 Assembly Constituencies of the Haryana Assembly elections. 
  • In the State Assembly elections, held in May 2001, in the states of Tamil Nadu, Kerala, Puducherry and West Bengal, the EVMs were used in all the Assembly Constituencies. Since then, for every State Assembly election, the Commission has used the EVMs. 
  • In 2004, in the General Election to the Lok Sabha, the EVMs (more than one million) were used in all 543 Parliamentary Constituencies in the country. 
  • VVPAT introduction — Voter Verifiable Paper Audit Trail — 2013 pilot — 2019 general election — VVPAT with every EVM — paper trail added 

Legal Backing of EVMs in India

  • Representation of the People Act, 1951
    • EVMs have statutory backing under Section 61A of the Representation of the People Act, 1951. This provision allows the use of voting machines in elections, subject to conditions specified by the Election Commission of India.
  • Conduct of Elections Rules, 1961
    • The detailed procedure for use of EVMs is provided under the Conduct of Elections Rules, 1961.

Development & Manufacturing

Technical Architecture of Indian EVMs

  • Components 
    • Control Unit (CU) — with Presiding Officer — enables voting — records and stores votes
    • Balloting Unit (BU) — with voter — physical buttons corresponding to candidates — voter pressing to cast vote
    • VVPAT (Voter Verifiable Paper Audit Trail) — printing slip showing candidate voted for — visible to voter for 7 seconds — slip falling into sealed compartment — paper record of every vote
    • Connection — CU and BU connected by cable — not wireless — physical connection only
  • Technical Specifications 
    • One-time programmable (OTP) chip — program burned into chip once — cannot be reprogrammed or updated after manufacturing — significant security feature
    • No external interface — no USB port, no internet connection, no Bluetooth, no WiFi — cannot receive or transmit data externally
    • Standalone operation — each EVM operating independently — no central server — no network — decentralised by design
    • Power — ordinary batteries — no mains electricity connection — eliminating remote access through power lines
    • Operating system — EVM does not have an operating system (OS) — According to the poll body, it only uses firmware or machine-level instructions that are embedded in a one-time-programmed (OTP) memory to eliminate any scope for reprogrammability.
  • VVPAT — The Paper Trail 
    • Thermal printer — attached to balloting unit — printing paper slip for every vote — showing candidate name and symbol
    • Voter verification — slip visible through transparent window for 7 seconds — voter verifying their vote before slip falls into sealed compartment
    • Sealed storage — slips accumulating in sealed VVPAT compartment — not accessible during voting — available for post-poll verification
    • Statistical verification — post-poll — ECI mandating VVPAT count in 5 randomly selected booths per assembly constituency — comparing with EVM count
    • The VVPAT slip is a thermal paper coated with a chemical to ensure print retention for five years.

Benefits of EVMs

  • Reduces Booth Capturing and Ballot Stuffing
    • Paper ballot era — booth capturing — most serious electoral malpractice — criminals seizing booths — stuffing ballot boxes — entire constituencies effectively stolen 
    • EVMs reduce this possibility because votes can be cast only one at a time and the machine records votes in a controlled manner. This has reduced the scale of electoral malpractice associated with paper ballots.
  • Faster Counting and Timely Results
    • EVMs allow quick counting of votes compared to manual counting of paper ballots. This reduces administrative delay, minimises disputes during counting and ensures faster declaration of election results.

      • Error reduction — manual counting — human error, fatigue, disputed counting — EVMs producing precise digital count — no miscounting

  • Reduces Invalid Votes
    • In the paper ballot system, votes could become invalid due to wrong stamping, unclear marking or multiple markings. EVMs reduce such errors because the voter presses a button against the chosen candidate, making the voting process simpler and clearer.
  • Cost-effective in the Long Run
    • Although EVMs require initial investment, they reduce recurring costs related to printing, transporting, storing and securing huge quantities of ballot papers. 
    • They also reduce the manpower and time required for counting.
  • Environment-friendly
    • EVMs reduce the need for printing crores of ballot papers. This saves paper and reduces the environmental cost of conducting large-scale elections in a country like India.
  • Administrative Efficiency
    • EVMs simplify election management by reducing the logistical burden of ballot paper printing, transportation, storage and manual counting. This is significant in India because elections involve large numbers of voters, polling stations and candidates.
  • Enhances Accessibility
    • EVMs make voting easier for many voters because the process is simple and quick. Symbols, names and buttons help voters identify candidates more easily compared to handling large ballot papers.
  • VVPAT-based Verification
    • The introduction of VVPAT has added a physical verification layer. Voters can visually verify that their vote has been recorded correctly, and VVPAT slips can be used for audit and verification in selected polling stations.

Concerns / Issues with EVMs

  • Trust Deficit among Political Actors
    • Even if EVMs are technically secure, repeated allegations by political parties create public doubt. In elections, perception is also important because democratic legitimacy depends not only on actual fairness but also on public confidence in the process.
  • Limited VVPAT Counting
    • At present, only a limited number of VVPAT slips are matched with EVM results. Critics argue that wider VVPAT verification would increase transparency, while the Election Commission has maintained that full counting may delay results and create logistical difficulties.
  • Allegations of Tampering
    • Political parties and activists have raised concerns about possible tampering, manipulation or malfunction. The Election Commission maintains that Indian EVMs are standalone machines and not connected to the internet, but the persistence of allegations affects public trust.
  • Malfunctioning and Technical Glitches
    • During elections, some EVMs or VVPAT machines malfunction due to technical issues, battery problems or handling errors. Even if such cases are isolated and machines are replaced, they can delay polling and create suspicion among voters.
  • Administrative and Chain of Custody Concerns 
    • Public confidence depends on secure storage, transport, sealing and monitoring of EVMs before and after polling. Any allegation of weak handling, unauthorised movement or poor security can create doubts about election integrity.

      • Critics argue that the Election Commission has no convincing reason to keep the EVM source code secret when Brazil, another country using electronic voting, allows controlled access to its source code, conducts public security tests, and still runs credible elections.
        • 12 months before every election, Brazil’s Superior Electoral Court (SEC), a judicial-linked body authorised to supervise and conduct elections, opens the source code to be examined by nearly 100 oversight entities. These include not just the representatives of political parties, but also the Brazilian Bar Association, the Brazilian Computer Society, the federal police, a slew of public universities, etc. All of them are bound by confidentiality agreements not to circulate the source code in the public domain. 
  • Political Trust Deficit — Institutional Confidence Crisis 
    • Public confidence — significant portion of population — particularly opposition supporters — not trusting EVMs — democratic legitimacy concern regardless of technical reality 
    • ECI credibility — ECI’s own institutional credibility — declining in some circles — reducing ability to reassure on EVM integrity 
  • VVPAT Concerns 
    •  Some critics have raised concerns about the reliability of VVPAT systems, citing instances of malfunctioning printers, paper jams, and discrepancies between electronic and paper records.

Way Forward

  • Strengthen VVPAT Verification
    • The number of randomly selected VVPAT slip counts can be increased in a scientifically designed manner to improve audit confidence without delaying results excessively.
      • Increase verification percentage — from 5 booths to statistically meaningful sample — independent statistical experts determining adequate sample size 
      • Transparent counting — VVPAT counting — in presence of all candidates’ agents — full transparency 
  • Source Code Transparency 
    • Conditional disclosure — source code to independent technical experts — under non-disclosure agreement — enabling technical audit without public exposure 
  • Improve Transparency of EVM Protocols
    • The Election Commission should regularly publicise EVM security procedures, mock polls, sealing processes, storage safeguards and counting protocols in simple language for voters and parties.
  • Stronger Chain of Custody
    • Storage, transport and security of EVMs should be monitored through CCTV, GPS tracking, candidate-agent presence, proper documentation and strict sealing protocols.

  • Building Institutional Trust 
    • ECI independence — protecting and strengthening ECI’s institutional independence — credibility depending on institutional autonomy

EVMs have improved the speed, efficiency and administrative manageability of Indian elections. However, elections depend on public trust as much as technical accuracy. Therefore, the way forward is not to reject EVMs, but to strengthen VVPAT verification, transparency, chain of custody and institutional credibility so that electoral efficiency is matched with democratic confidence.
